These Terms and Conditions ("Terms") govern your use of the website located at helioscap.co.uk ("the Website") and any related services, including our waitlist and pre-order facilities. The Website is operated by Hephaestus Ventures Ltd, a company registered in England and Wales under Company No. 16933457, with its registered office in Cambridgeshire, United Kingdom ("we", "us", "our", or "the Company").

By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the Website.


2. Acceptance of Terms

By using the Website, joining the waitlist, or placing a pre-order, you acknowledge that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You will use the Website only for lawful purposes and in accordance with these Terms.
  • All information you provide to us is accurate, current, and complete.

3. Use of the Website

You may use the Website for personal, non-commercial purposes only. You agree not to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website without our express written permission.
  • Use any automated system, including but not limited to robots, spiders, or scrapers, to access the Website.
  • Introduce any viruses, trojan horses, worms, or other malicious software or code.
  • Attempt to gain unauthorised access to any part of the Website, its servers, or any connected databases.
  • Use the Website in any manner that could disable, overburden, or impair its functionality.

We reserve the right to restrict or terminate your access to the Website at any time, without notice, for any reason we deem appropriate.


4. Intellectual Property

All content on the Website — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof — is the property of Hephaestus Ventures Ltd or its content suppliers and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

The "Helios Cap" and "Helios 320" names, logos, and all related product and service names, designs, and slogans are trademarks of Hephaestus Ventures Ltd. You must not use such marks without our prior written consent.


5. Waitlist

The Helios 320 Laser Helmet is not yet available for sale. By joining the waitlist, you acknowledge and agree to the following:

  • No obligation to purchase. Joining the waitlist does not constitute a binding commitment to purchase the product by either party, nor any offer or acceptance of an order.
  • Indicative pricing. The listed price of £999 is indicative and may be subject to change prior to the product becoming available for sale.
  • Estimated timelines. Any estimated launch dates are provided in good faith but are not guaranteed.
  • No payment taken. No payment is taken at the point of joining the waitlist. Separate purchase terms will be provided at checkout when the product is available to buy.
  • Right to unsubscribe. You may remove yourself from the waitlist at any time by contacting us at [email protected].
  • Data use. Your name and email address will be used solely for the purpose of communicating Helios 320 product updates and launch information, in accordance with our Privacy Policy.

6. Returns, Warranty & Statutory Rights (Post-Launch)

The following terms will apply to purchases of the Helios 320 Laser Helmet once the product becomes available for sale. They are published here for transparency and will be restated at checkout.

6.1 14-Day Cooling-Off Period

Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order and return the product for any reason within 14 days of receiving it. The product must be returned in its original condition. We will refund the price of the product within 14 days of receiving the returned item.

6.2 Manufacturer Warranty

The Helios 320 is covered by a two-year manufacturer warranty against defects in materials and workmanship, starting from the date of delivery. This warranty does not cover damage caused by misuse, accidental damage, or unauthorised modification.

6.3 Statutory Rights

Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms. This includes the right to goods that are of satisfactory quality, fit for purpose, and as described. Where the product does not conform to these standards, you may be entitled to a repair, replacement, or refund in accordance with applicable law.


7. Product Description & Disclaimers

The Helios 320 Laser Helmet is a low-level laser therapy (LLLT) / photobiomodulation device designed for personal use as a wellness product. Please read the following disclaimers carefully:

7.1 Not a Medical Device

The Helios 320 Laser Helmet is a general wellness device. It is not a registered medical device and has not been evaluated, cleared, or approved by the Medicines and Healthcare products Regulatory Agency (MHRA), the U.S. Food and Drug Administration (FDA), or any other medical regulatory body. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

7.2 No Guaranteed Results

While low-level laser therapy has been the subject of published research, individual results may vary significantly. We make no representations, warranties, or guarantees — whether express or implied — regarding the effectiveness of the Helios 320 Laser Helmet for hair regrowth, hair thickness, or any other outcome.

7.3 Consult a Healthcare Professional

If you have a medical condition, are undergoing treatment for hair loss, or have any concerns about using a photobiomodulation device, you should consult a qualified healthcare professional before use. The information provided on the Website is for general informational purposes only and should not be considered medical advice.

7.4 MHRA Disclaimer

The Helios 320 Laser Helmet has not been registered with or reviewed by the MHRA as a medical device. No claims made on this Website should be interpreted as medical claims. The product is marketed and sold solely as a general wellness device in accordance with applicable regulations.

7.5 Accuracy of Information

We endeavour to ensure that all product descriptions, specifications, and other information on the Website are accurate and up to date. However, we do not warrant that product descriptions or other content on the Website are error-free, complete, or current. Product specifications may be subject to change prior to commercial release.


8. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Website and all content, materials, and information provided therein are made available on an "as is" and "as available" basis, without any warranties of any kind.
  • Hephaestus Ventures Ltd, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website or the product.
  • Our total aggregate liability to you for any claims arising from these Terms shall not exceed the amount you have paid to us (if any) in the twelve (12) months preceding the claim.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hephaestus Ventures Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or in connection with your use of the Website, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.


14. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting the revised Terms on the Website. Your continued use of the Website following any changes constitutes your acceptance of the updated Terms.


15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Website, constitute the entire agreement between you and Hephaestus Ventures Ltd with respect to your use of the Website.
